What do you mean by filing ?
Is there anything to file for AC21 ? I somehow thought it's implicit and you just have to let USCIS know that you have changed your job. That's all. That too is not a mandatory task but most lawyers suggest it to play safe. I think it's matter of sending the letter with details to USCIS.
You just be prepared to explain at the 485 interview or reply to RFE's or NOID's if sent by USCIS, which wont happen till your 485 date is current or your sponsoring employer withdraws 140.

I have approved H1b renewal and my wife went to India and got h4 visa based on my approval, I have not stamped yet,

since my wife already got the visa stamped, do you think I need to verify for PIMS ?
or it should have been already verified .

Even if your status changed to H1 in October 2004 and you started working in November 2004 for a second employer following approval for that employer, I would say it is just 30days and would not be an issue in future GC application. Don't worry about it.

today that it has received a sufficient number of H-1B petitions to
reach the statutory cap for fiscal year (FY) 2011.� USCIS is notifying
the public that yesterday, Jan. 26, 2011, is the final receipt date
for new H-1B specialty occupation petitions requesting an employment
start date in FY2011.

The final receipt date is the date on which USCIS determines that it
has received enough cap-subject petitions to reach the limit of
65,000.� Properly filed cases will be considered received on the date
that USCIS physically receives the petition; not the date that the
petition was postmarked.� USCIS will reject cap-subject petitions for
new H-1B specialty occupation workers seeking an employment start date
in FY2011 that arrive after Jan. 26, 2011.

USCIS will apply a computer-generated random selection process to all
petitions that are subject to the cap and were received on Jan. 26,
2011. USCIS will use this process to select petitions needed to meet
the cap.� USCIS will reject all remaining cap-subject petitions not
randomly selected and will return the accompanying fee.

On Dec. 22, 2010, USCIS had also received more than 20,000 H-1B
petitions filed on behalf of persons exempt from the cap under the
‘advanced degree’ exemption. USCIS will continue to accept and process
petitions that are otherwise exempt from the cap.� Pursuant to the
Immigration and Nationality Act, petitions filed on behalf of current
H-1B workers who have been counted previously against the cap will not
be counted towards the congressionally-mandated FY2011 H-1B cap.
Accordingly, USCIS will continue to accept and process petitions filed
to:

extend the amount of time a current H-1B worker may remain in the U.S.;
change the terms of employment for current H-1B workers;
allow current H-1B workers to change employers; and

Hi,Advise please!
1)I got H1B visa stamp until June 30,2007. Sampe company (Hospital), I got extension approval notice until July 30,2007 (i.e 30 days).

2) Hospital applied for New H1B (Change of employer) from July 31st,2007 until June 30,2010.
Can i go for stamping in June (OR) I have to wait for until July 30,2007.

I think you have to file in 2 states. Suggest you to consult a tax consultant instead of looking at the IV forums for the answer.

It is partly my fault as I should have noticed when I started a new project in end August in South Carolina.

But now looking at my W2 it shows that my employer has been filing taxes in my previous state Missouri for the entire year. How should I go about correcting this? I was in Missouri for 5 months and in South Carolina for the remainder. In which state should I file my tax too?

Any help will be greatly appreciated

With GC process bound to take long, staying at the same place to avoid changing address may be a big challenge.
Has anybody considered using PO box for address on I-485? My lawyer did not allow me to use PO box during July 2 filing.
Will it be possible to go online and change to PO box address for I-485?
Does INS has any issues in sending GC to po box address?

Gap in employment and porting priority date:

What if there is a gap of employment between leaving the previous employer who made the initial green card application under EB3 and joining the new employer who is willing to make a new application under EB2.

I-140 is approved, I-485 was pending for more than six months when the employee left the first company and has had a gap in employment for a few months. The employee has joined the new company using EAD. I-140 has not been revoked.

Would applying for the green card under EB-2 and trying to port the EB-3 priority date cause any complications given the gap in employment. The new job satisfies the same or similar job requirement with a 50% bump in salary and meets the EB-2 requirements. Would really appreciate your insight on the risks to be aware of if any due to the gap in employment. Thanks!

Myself and my wife walked into the ASC today. The officer in the front mentioned "are you coming in early" we said yes and then he said u need to fill out the forms etc so we got it done today. I persume since the finger prints are scanned and notified to USCIS so I don't have to send to the service center


I am not sure whether a way to prepone it. You can try going for FP. They did not say anything about the future date.

Does anyone know if people who've filed for I-485 can claim unemployment insurance?......The client where I was working cancelled my project due to budget cuts :(....I was wondering if I can claim unemployment till I find a new job. Does any one know any non-desi companies hiring in the Michigan, Ohio, Illinois or Midwest in general?.....I am PMI certified Project Manager with J2EE background. Any prompt help would be highly appreciated.

Hello All,

When I was doing my education (MS) my credit dropped drastically and recently like 2 years back it went for collections too. However I cleared all my credit card debts but it still shows on the credit report that as severe deliquencies and number of open accounts.

Next month I'm applying for AOS - I want to know whether bad credit will have any affect of the approval or denial of the application? :mad:

so you are saying that it took 1 year for USCIS to send you NOID?
you'd mentioned 140 withdrawl in dec2009.

AC21 is not mandatory in my opinion ( my lawyer's too) , I changed job this Aug
saw a soft LUD on my 4 years ago approved 140 after changing jobs..it been 3 months to the soft LUD.
seeing your pattern looks like they may send some letter but have not got any yet.

Looking back at it from the light of the early twenty-first century, one of the most astonishing things about Funeral Parade of Roses is just how little seen it has been. This in itself is something of an enigma. It's not like the title is unknown outside of Japan, having been pretty extensively discussed in books like David Desser's Eros Plus Massacre and Noel Burch's To the Distant Observer. But I was really amazed given its international reputation to learn that Eureka's DVD release actually represents the first of any kind for the foreign home video market. One can only hope that the belated rectification of this grave oversight will serve in some degree to hoist its director Toshio Matsumoto's name up to a higher level on the totem pole of internationally visible filmmaking greats than it hitherto has been and lead to more widespread releases of his other films. Because on the evidence of this kaleidoscopic view of Tokyo's vibrant gay countercultural scene of the late 60s, his work represents something of an undiscovered treasure trove for the Western viewer.




Just to put the name into context, Matsumoto was born in Nagoya in 1932 and rose to become one of the key players in the early Japanese experimental scene with short films like Silver Ring (Ginrin, 1955), the 18-minute documentary on the renewal of the US-Japan security pact Ampo Jouyaku (1959), 300 Ton Trailer (1959), Record of a Long Wide Line (Shiroi Nagai Suji no Kiroku, 1960) and Magnetic Scramble (1968). Many of these early works have been recently made available for the first time in Japan in the three-volume box-set Toshio Matsumoto Experimental Film Works 1961-1987.

Funeral Parade of Roses is his first feature-length work, and was made possible through the support of the Art Theatre Guild, who produced and distributed the film. Though the following decades have seen Matsumoto continuing to practice within the fields of experimental cinema and video installation, subsequent theatrical features, which include Pandemonium (Shura, 1971), A 16-Year-Old's War (Juroku-sai no Senso, 1972) and Dogura Magura (1988), have been rather thin on the ground.




The experimental background is very much in evidence in his first feature. Trying to explain the pleasures of such a scrambled impressionistic piece as Funeral Parade of Roses in plot terms is a pretty fruitless exercise, although the disjointed narrative does reach fever pitch in the latter moments, with developments inspired by the ancient legend of Oedipus Rex so succinctly described in the dark ditty written by 50s American singer/satirist/maths professor Tom Lehrer: 'There once lived a man called Oedipus Rex / You must have heard about his odd complex / His name appears in Freud's index / Because he loved his mother ...'

Those aware of the mythological underpinnings of Freudian theory might have some inkling as what to expect in the gruesome closing scenes. While these in themselves go some way in giving those attempting to sum up the essence of this work in a few choice phrases something to hang their hats on, the net effect of the film is considerably more substantial than such a dime-store Freudian denouement might suggest.




This is as much due to the freak charismas of those in front of the camera as the talent of the director behind it. Admirably carrying the main weight of the drama on his shoulders among a cast predominantly made up of non-professionals and counter-cultural mini-celebrities is a player known solely as Peter. According to an incredibly youthful looking Matsumoto on the on-disk interview, he was scouted especially for the part while working as a transvestite bar hostess in Roppongi. One can immediately see how he caught the filmmaker's eye: Peter, who subsequently played the Fool in Akira Kurosawa's Ran and turned up in several other films during the 70s (the most familiar mainstream appearance perhaps being the 1970 entry of the long-running Shintaro Katsu vehicle Zatoichi, Fire Festival), certainly has all the right moves, not to mention a doe-eyed vulnerability and the ability to project a potently polymorphous form of sensuality that belies his gender. It would be difficult to imagine the film with anyone else in his high heels. In the role of the androgynous bar worker Eddie, Peter wrestles with inner demons while jostling for the affections of drug-dealing cabaret-manager Gonda (Tsuchiya; one of the few professionals in the cast with several roles behind him in Kurosawa films such as The Seven Samurai and Throne of Blood) with rival cross-dresser Reda (Ogasawara) and taking centre stage in a documentary being made about Tokyo's gay culture.




The story really remains only a ruse for a work that is best seen as a fascinating reflection of a long-vanished place and time, caught in a cross-current of international pop-cultural styles and influences and not dissimilar to what was going on in similar circles in other far-flung parts of the world. The colourful underground milieu, populated by a rag-tag collection of cross-dressers, bohemians, druggies and drop-outs, bares easy comparisons with the environment fostered by Andy Warhol and his disciples at his Factory studio in New York - at one point the American underground film scene is explicitly mentioned when one of the characters quotes Jonas Mekas (though another has to correct the mispronunciation of Mekas' name.) The exuberant costumes and pop-art sensibilities recall all the excesses of the European swinging 60s scene as celebrated in William Klein's kitsch cult oddity Who Are You, Polly Magoo? (1966), and it is rumoured that Matsumoto's false-eyelashed protagonists served as the inspiration for Kubrick's A Clockwork Orange. Finally the experimental melange of dramatised sequences and documentary footage assembled in a cocktail of freeze frames, onscreen text, sped-up sequences, solarised or over-exposed shots, distorted wavering news footage filmed directly from TV and stroboscopic cross-cuts immediately puts one in mind of the French New Wave.




I offer these foreign examples primarily as descriptive points of reference. While Matsumoto readily acknowledges the early impact of nouvelle vague director Alain Resnais on his work, Funeral Parade of Roses amounts to much, much more than the sum of its influences. And anyway, though its focus on experimental filmmaking technique is very much in keeping many of the other films produced by the Art Theatre Guild - typically those of Nagisa Oshima, Shohei Imamura, Masahiro Shinoda, Susumu Hani and Kiju Yoshida - Matsumoto's film never quite seems like the dry meta-textual exercise in formalism of some of his contemporaries. It also boasts its more playful moments, for example Reda and Eddie's under-cranked showdown, alongside its more poignantly tragic dimension revealed through flashbacks to Eddie's traumatic fatherless childhood.

The General rule is You are eligible for H1B extn if the following conditions are met

a) Labor applied on your behalf atleast 1 yr prior to maxout date. You will be eligible for 1 yr extensions

b) Labor and I-140 approved in that case it will be 3 yrs extensions

Now I was in similar situation where in i applied for labor in 6th yr, Labor got cleared in 2 months, I-140 got cleared in 2.5 months so now i am eligible for 3 yr extn.

These days Labor certifications are taking a bit longer time (Atlanta is the only place they are doing it ) So it may take more time. Also one another thing needs to be considered is if there is any RFE then it takes longer.( Few cases pending beyond a year)

Do a research on various RFE and do your paperwork in much more details you will probably end up without any RFE on your case

it's catch-22 situation. its easy to get 797, but not VISA, entry to US and most importantly a job in this economy. same as housing, cheap prices, but no job security. not to state the obvious but, there is a reason why cap didn't reach in a day.

a good idea though is, apply for H1, get 797 approved. Normally its for 3 years from Oct'09. But don't go for stamping for another year(not sure if u can wait on stamping) or the period legally allowed and don't try to come to US for another six months or the period legally allowed . So u can come to US in 2011, if its allowed legally. does any one know the law?

Dear Friends,

I have changed my employer after 180 days of my pending I-485. I have not communicated USCIS about this. I was able to renew my EAD, and AP online with proper documentation without any issues.

I am planning to travel to India on Advance Parole now. Wondering if I can show my former employer's documentation such as I-485, I-140 approvals if anything arises while going or returning. Do you anticipate any issues with this? or do I need to carry any information about current employer, and my Job?. Appreciate your help.

As your H-1B has been withdrawn prior to your filing for the H-1B change of employer, you are now out of status. An H-1B withdrawal is technically effective immediately upon receipt by USCIS.

The best bet would be to file for a new H-1B (assuming that you did not exhaust your six years of H-1B time) under the fiscal year cap as this has not been reached.

You should notify your legal counsel of the H-1B withdrawal and see how they want to handle it. While it is true that you are currently not in status, they may have an alternate policy.

Even so; not being a Vote bank is the reason we cannot do anyting here. Plus we are not united enough to generate enough funds or show enough economic impact (i.e. make our case) with lawmakers to get USCIS to clean up their act. IV is our best chance.
