Your I-485 will not get approved until the dates become current for you. For eg. say in March 2009 bulletin (which is valid from April 1st of 2009), your priority date becomes current. Your I-485 can be approved only after April 1st. Just have your wife's application ready and apply on the first day when your priority date becomes current.

I recieved a letter from USCIS saying "we have forwarded your inquiry to Sec 245 Unit. You will be notified by mail at later date".
What exactly this means?
Do I need to worry about this Sec 245 Unit. Is it good or bad?

Now that it is 180 days Since Jul 2nd and some of us are thinking about AC21. Some are invoking AC21 and sending the documentation as soon as they change jobs and others are thinking of not informing the CIS (AFAIK Informing CIS is not mandatory as per AC21).
A friend of mine changed jobs 3 times after filing I485 never informing the CIS and got his GC without any RFE. He has the luxury of the lawyer who originally filed the I485 work with him and the company never revoked I140(because they laid him off). Another friend sent the documentation about invocation of AC21 and got RFE.
It is expressed in other related threads to start a poll so that we can have an idea of trends in AC21 usage.
This is a simple poll.

Since your attorney is not filing (No G28 is filed when you DIY). I did this and I got approval for both EAD/AP in a month's time.

Your change of status will come under 65K cap..and if the cap is not increased (lets still hope for the best) then it's going to be lottery again and it's your luck to be selected in the lottery. because of lottery you can not plan a lot of things..

Question: Did anybody receive confirmation about their AOS applications being returned after filling in early July (Say on the 2nd or 3rd)? I know there have been rumors about a few returned applications but I haven't actually found anyone in such situation + my attorneys confirmed today that USCIS specifically instructed not to return/reject them.
An answer will magically appear after you have contributed to the IV cause.

Hi,
I am working for "Company A" on L1B from Nov 2006. In 2008 April "Company B" filed H1B and it got approved and received approval letter with I-94 effective from Oct 1st 2008.
After getting H1B I did not move to Company B and continued work with "Company A" on L1B Visa. To void the I-94 received with my H1B Approval I traveled my Home country on Sep 28th 2008 and returned to US on Oct 6th 2008 on L1B visa and continuing my Job with "Company A"
My H1B Employer (Company B) did not revoke my H1B since I have not started working for him.
Now Company B is going to renew my L1B visa for another 2 years.
If they renewed my L1B Visa, what will happen to my H1B?
In future if I want to switch to H1B, can i switch to H1B with my current H1B or do I need to file new H1B with fresh quota (Which opens in April)?
I am really tensed now and I am not understanding whether I should go for L1B extension or do I need to switch to H1B immediately to keep my H1B status alive? What I want to now is for some time i want to continue my job with Company A on L1B by going for L1B renewal and later once the recession is over I want to change my status to H1B? can I do this?
Please advice me what steps I should take to continue in USA?

b) If this Company B were to file for H1-B , as I understand it would count towards the 2007-2008 quota which opens on April 1st '07...does this scenario also force you to not start working till Oct'07 (which is when ppl who file in the 2007-08 quota are supposed to start working).
If you are already on a H1 and are only doing a H1B transfer, it will not not count towards quota (unless your current H1B is for non-profit org and new H1B is for a for-profit org). You can start working as soon as you get the receipt. But, if you are applying for a fresh H1B, it will count towards quota and you will have to wait till Oct 07 before starting to work.

I checked with my attorney, she there is possiblity of it getting approved but there is risk also.
In progressive experience I meet even the experience criteria if I include all my work experience prior to me passing the degree. could this work experience be used.

this is not consistent. I just booked appt for my in laws yesterday 54 year old but did not get 157 pop up just 156. hope this helps.
you can log in to the vfs website and see if a DS157 is available for filling in. If yes, then just fill it out and print it.
