South Korea threatenedIs letter from employee needed for filing I-485 for my spouse. I filed I-485 under EB3 last August and it's still pending. She takes my PD and my PD will be current in May. I have an old letter from my employer when filing my I-485 last August but was wondering if a new letter from employer is needed or the old one would do.

Thanks for your reply. what's the continuous employment criteria? Is the reason my attorney enter '5/17' instead of '5/15'?
I have a letter from HR and saying the last day at my previous company was '5/15'. very boring!!!!
All experience letters should indicate the last date of your employment as 5/15.

Need some urgent help. I just efiled my AP for myself, my spouse and my child and when I was done doing it, I noticed that it generated a notice number starting LINXXXXXXX. My problem is this - when I originally filed my I-485 last year during july fiasco, I was located in CA. But currently I am in Texas. That was the address that I input in the application too. But I am not sure why it generated a receipt # with LIN number. May be it was because of the question as to where my 485 is currently pending. The reason I am worried is because, when I filed my EAD exten (thru my lawyer), he had mentioned that he sent the EAD application wrongly to Nebraska instead of sending it to Texas (since I am in texas now), he made me re-do the application and sent it to texas and got me a SRC number for EAD extn. Now, do you think that I am in the right path? Do I need to send the supporting documents to Nebraska or Texas? Or is my AP application fees gone for good. Please help, as this is making me worried too much. Thanks.

The new job has to be same or similar irrespective of whether you transfer on EAD or H1.

South Korean speed skatersAttorneys sometimes do not provide case number because they do not want you to be calling BEC for to inquire your case. Try convincing your employer you will use it only for online status check and hopefully they will give it to you.

Does anybody know what the fees are for filing EAD (yearly) extensions if you filed for EAD, 485 before August 17.

AR-11 has to be filed by all non-citizens, that translates to GC holders or permanent residents as well.
You dont have to provide COS for I-140 if all correspondence is going to your employer and you dont have any other pending application

Absolutely, you can apply a fresh labor any time irrespective of your filing stage. Lots of people do that.

But in my case i have over 4 years of work experience, but do not have a masters degree, so any idea if that is possible ?
My gut feeling is that regardless if i'm not able to qualify for EB2, my PD JUN 2006 will get current in a couple of months - just hopefull :rolleyes:

in Pyongyang, North Korea!i have read some place in this forum that as long as you maintain your full time primary job you are entitled to use your ead for other smaller assignments without losing your H1 status. But then again I am not a lawyer just sharing what I have read.
AFAIK, Using EAD either for a FT or PT job should invalidate other non-immigrant work authorization documents like H1B since EAD is a derivative benefit of filing for immigrant status and you cannot mix and match your status...
If this is not true and there is a discussion on this forum clarifying that, I would like to know too...

I also have a similar case like the original poster (TexDBoy). I want to move from Boston area to somewhat warmer area.
I have not asked my employer if they would allow me to do this, but my family wants to really move out of Boston (too cold and tough winters). While, i do have a nice job where i see stability (I have been in the company since 8 years now), I would also like to see if I can get to some good companies in the southern places like Dallas, Austin, Raleigh, Atlanta...
What do you guys think?
The last poster mentions getting a LCA.. Does that mean we have to file another Labor? I already have labor and 140 cleared and my 485 is pending with June 2003 date (EB3)
does that mean no hope left ? what r the other options ? isn't this whole process is for future employment and if i am licensed now than whats the problem in future employment i don't understand that part "future employment". i am on h1 now and if i will get my residency than i will be working at that position and i am licensed now. then why does the old date matters.
